The EU AI Act's human oversight requirements go far beyond documented processes. Article 14 requires that natural persons assigned to human oversight understand the system's capabilities and limitations, are aware of automation bias, and can correctly interpret the system's output. Article 26 places parallel obligations on deployers — organisations using AI systems — to ensure these conditions are met in practice.
Article 4 — enforceable since February 2025 — requires a sufficient level of AI literacy for all staff dealing with AI systems. This is not a generic awareness standard. It is a role-differentiated obligation that must account for the person's technical knowledge, experience, education, and the context in which AI systems are used.
Most organisations have interpreted these articles as documentation requirements. They are not. They are capability requirements — and the distinction is consequential.
Article 14 requires that human oversight be assigned to persons who understand the system's capabilities and limitations, can correctly interpret outputs, and can decide not to use the system or override its output. Understanding is not awareness. It is a demonstrable competence.
The article explicitly references the risk of automation bias — the tendency to over-rely on AI outputs. This is not a training gap that can be closed with a workshop. It is a measurable psychological phenomenon that must be assessed and mitigated at the individual and organisational level.
Compliance with Article 14 therefore requires more than role assignment. It requires evidence that the assigned individuals possess the psychological readiness to exercise genuine oversight — including the willingness to challenge, escalate, and override when the evidence warrants it.
Deployers must assign human oversight to natural persons with the necessary competence, training, and authority. They must ensure those persons understand the system's intended purpose and can monitor for risks. This is an operational obligation — not a policy one.
Article 26 also requires deployers to inform workers and their representatives that they will be subject to the use of high-risk AI systems. This transparency obligation extends to the conditions under which oversight is exercised — not merely the existence of oversight roles.
For most deployers, the gap is not in policy documentation but in operational readiness. The question is whether the people in oversight roles can actually perform the functions the regulation requires — under real conditions, with real systems, under real pressure.

The article requires organisations to take into account the technical knowledge, experience, education, and training of the persons dealing with AI systems, as well as the context in which the systems are to be used. This means literacy programmes must be designed around the specific governance responsibilities of each role — not delivered as a one-size-fits-all awareness programme.
Demonstrating compliance with Article 4 requires evidence that literacy levels have been assessed, that programmes are role-differentiated, and that effectiveness is measured — not assumed. This is where most organisations currently fall short.
The common thread across Articles 4, 14, and 26 is the shift from documentation to demonstration. The EU AI Act does not ask whether you have written a policy. It asks whether the people operating under that policy can actually do what it requires.
This is a fundamental shift in regulatory expectation — from process compliance to capability compliance. Organisations that treat these articles as documentation exercises will find themselves exposed when regulators begin to assess not what was written, but what was demonstrated.
